After World War II, Troy N. Smith, Sr. returned to Seminole, Oklahoma, his hometown, and started working as a milkman. Realizing that delivering bread was less challenging than delivering milk, Smith purchased the Cottage Cafe, a small diner in Shawnee, Oklahoma. He eventually sold the cafe and established a fast-food service called Troy’s Pan Full of Chicken on the outskirts of the town. In 1953, Smith joined forces with a business partner to acquire a five-acre land plot that included a log house and a walk-up root beer stand named Top Hat. While both operated the root beer stand and transformed the log house into a steak restaurant, Smith noticed that the stand’s sales of root beer, hamburgers, and hot dogs were averaging $700 per week. Deciding to focus on the more lucrative root beer stand, Smith bought out his partner.

Initially, customers at Top Hat parked their cars anywhere in the gravel parking lot and walked up to place their orders. During a visit to Louisiana, Smith encountered a drive-in that utilized speakers for ordering. He believed that by controlling the parking area and allowing customers to order from speakers at their cars, with carhops delivering the food, his sales would increase. To test his theory, Smith used cars borrowed from a friend who owned a used-car lot to create a parking layout. He also had “jukebox boys” install an intercom system in the parking lot. The results were astounding, with sales immediately tripling. Impressed by the success, Charles Woodrow Pappe, an entrepreneur, approached Smith. They negotiated the first franchise agreement in Woodward, Oklahoma, in 1956, solidifying the deal with a handshake. Two more drive-in locations were built in Enid and Stillwater by 1958.

However, as the “Top Hat” name was already trademarked, Smith and Pappe decided to change it to Sonic in 1959. The new name aligned perfectly with their existing slogan, “Service with the Speed of Sound.” The first Sonic sign was installed at the Stillwater Top-Hat Drive-In, marking the beginning of a successful brand overhaul. Although Smith and Pappe were frequently approached to help open new franchise locations, there was no official royalty plan in place at that time. To address this, the pair decided that their paper company would charge an additional penny for each Sonic-label hamburger bag sold, with the proceeds split between Smith and Pappe. While franchise contracts were drawn up under this plan, there still existed no joint marketing strategy, standardized menu, or detailed operating requirements.
